The Issue Legislation has been introduced in Wisconsin regulating commercial dog breeders. Senate Bill 308, along with companion Assembly Bill 567, defines “commercial dog breeder” as “a person who is engaged in the business of breeding dogs and who either sells, or offers to sell, at least 60 dogs in a year or has at least eight breeding female dogs”. This bill would require commercial breeders to be licensed by the Department of Agriculture and sets forth penalties for violators as well as remedies for purchasers. The Impact This legislation requires the Department of Agriculture, Trade and Consumer Protection (DATCP) to create minimum standards for facilities where commercial dog breeders operate and specifies requirements for humane care to be provided by commercial dog breeders. The department is also charged with establishing rules relating to the transportation of dogs by commercial breeders, the minimum age for the sale of puppies, revocation of licenses, record-keeping requirements and space/exercise requirements for dogs. The bill also prohibits retailers from purchasing dogs from commercial breeders if the retailer knows the breeder is not licensed.
